Who pays the Buyers agent in Massachusetts?

In Massachusetts, the answer is: it depends on the agreement negotiated during the transaction.

Traditionally, the seller paid both the listing agent and the buyer’s agent commission from the proceeds of the home sale. The listing brokerage would then split part of that commission with the buyer’s agent.

However, after the 2024 National Association of Realtors settlement, buyer agent compensation became much more transparent and negotiable. Buyers now typically sign a written buyer agency agreement that explains how their agent will be paid.

Today in Massachusetts, there are a few common scenarios:

Seller pays the buyer’s agent
Still very common, especially in competitive residential sales. The seller may offer compensation as part of negotiations. 
Buyer pays their own agent directly
Some buyer agreements require the buyer to cover all or part of the commission if the seller does not offer enough compensation. 
Shared or negotiated arrangement
Sometimes the seller contributes part and the buyer covers the difference.
